Soft Space Terms of Service

Effective as of 5th April 2012.

The following Soft Space Terms Of Service are between you and Soft Space Limited and its affiliates (“Soft Space”) and constitute a legal agreement that governs your use of the Soft Space product, software, services and related websites (collectively referred to as the “Service”). Soft Space offers you access to the Service conditioned on your acceptance of these Soft Space Terms Of Service, including your agreement to the Privacy Statement.

 

Soft Space’s Privacy Statement contains information about Soft Space’s practices for collection and use of information about you and your use of the Service. You agree that Soft Space may collect, use, transmit, process and store information related to you, your account and devices registered under it to operate and provide the Service in accordance with the Privacy Statement. Personal information collected through the Service may be stored and processed in Malaysia and any other country in which Soft Space or its service providers maintain facilities. By using the Service, you consent to the transfer of information outside of the country where you reside, including jurisdictions that may not have data privacy laws that provide equivalent protection to such laws in your home country. Soft Space may use and disclose your information and content (including the content of your communications) to comply with the law and lawful requests or legal process, enforce the terms and policies governing your use of the Service, including investigations of any potential violation, detect or prevent security, fraud or technical issues, protect the rights or property of Soft Space and its customers, when Soft Space believes in good faith that the disclosure is necessary to protect the personal safety of Soft Space, its employees, customers or the public, and as otherwise disclosed in the Privacy Statement.

 

3. Disclaimer of Certain Damages

In no event will Soft Space or any supplier or licensor be liable for any consequential, special, incidental, indirect or punitive damages, including damages for loss of profits or confidential or other information, for business interruption, for personal injury, property damage, for loss of privacy, for failure to meet any duty of good faith or reasonable care, for negligence and for any other pecuniary or other loss whatsoever, arising out of, based on, resulting from or in any way related to these Terms, the Service, your use of the Service, the Software, Linked Sites, Soft Space Content, or Third Party Materials or services, even if Soft Space or any supplier or licensor has been advised of the possibility of such damages.

 

4. Copyright Notice and Takedown Procedures

You agree to respect the intellectual property rights of Soft Space and third parties. If you believe that material available through the Service infringes the copyright of any third party, please notify Soft Space by using the Contact form. After receiving notice, Soft Space may remove or disable access to any infringing material. Soft Space has the right to terminate any account or right of access to the Service for infringement of Soft Space’s or others’ rights.

 

5. Changes to these Terms

Soft Space reserves the right to change these Terms at any time. The updated version will be effective upon the date of posting unless indicated otherwise in the updated Terms. Your acceptance of the Terms by clicking a box (if one is made available to you), or your continued use of the Service after the updated version of the Terms becomes effective, constitutes your binding acceptance of the updated version of the Terms. Soft Space reserves the right to terminate these Terms or the Service at any time. Also, Soft Space may suspend or terminate your access to the Service or any portion thereof at any time, if it believes you have violated the Terms (including violations of the Code of Conduct) without notice. You may discontinue your use of the Service at any time. Neither Soft Space nor its licensors or service providers will be liable to you for any termination of your access to the Service.

 

7. Notices

Soft Space may give you all notices (including legal process) that Soft Space is required to give by any lawful method, including by posting notice on the Service or by sending it to any email or mailing address that you provide to Soft Space. You agree to keep your email and mailing addresses current and to check for notices posted on the Service.

 

8. General

If a court of competent jurisdiction determines that any part of these Terms is invalid or unenforceable, then it will replace the invalid or unenforceable provision with a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect. The section titles in these Terms are used only for the parties’ convenience and have no legal or contractual significance. Soft Space may assign these Terms, in whole or in part, at any time with or without notice to you. You may not assign these Terms or assign, transfer, or sublicense your rights, if any, in the Service. Soft Space’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. These Terms (including the Privacy Statement) and any other incorporated terms constitute the entire agreement between you and Soft Space with respect to the Service. These Terms supersede all prior or contemporaneous communications of any kind between you and Soft Space with respect to the Service. Any translation of these Terms is done for local requirements. If there is a dispute between the English and any non-English version, the English version of these Terms will govern.

Soft Space respects your privacy. 2. Soft Space’s Use of Information

Soft Space and/or its service providers will use the Personal Information collected to provide you with the Contact.

Soft Space may also use and disclose Personal Information (including the content of your communications) to comply with the law and lawful requests or legal process, enforce the terms and policies governing your use of the Contact form, including investigations of any potential violation, to detect or prevent security breaches, fraud or technical issues, to protect the rights or property of Soft Space and its customers, and when Soft Space believes in good faith that the disclosure is necessary to protect the personal safety of Soft Space, its employees and customers or the public.

Co-Branded Services

Some services in connection with the Contact form may be co-branded and offered together with another company. If you register for or use these services, both Soft Space and the other company may receive your Personal Information collected in connection with the co-branded services.

Other Purposes

Soft Space may disclose personal information as consented to by you from time to time, including fulfilling any other purposes that are identified when the Personal Information is collected.

Soft Space will not use or disclose Personal Information for purposes other than those for which it was collected, except with your consent or as required or permitted by law. 4. Children Under Age 13

The Contact does not target and is not intended for children under the age of 13. Soft Space does not want to collect Personal Information from children under the age of 13. If Soft Space discovers Personal Information from children under age 13, Soft Space will delete that information.

Soft Space will not store your Personal Information for longer than is necessary to provide the Contact whilst you are using the Contact form. Therefore, when you return to the Contact you may experience a different Contact form due to new Personal Information being used to provide the Contact. Therefore, there will not be an opportunity to update your Personal Information.

Soft Space is committed to protecting the security of your Personal Information. Soft Space and the third party service providers that provide hosting services for the Contact use a variety of security technologies and administrative procedures to help protect your Personal Information from unauthorized access, use or disclosure with security measures appropriate to the sensitivity of the information. For example, your Personal Information is stored on computer systems located in controlled facilities with limited access.

The Contact may contain links to third-party websites, products and services, such as social networking sites and third parties who may offer additional products and services through the Service.
